General Terms

These Terms of Use and Sale (hereinafter: "Terms") govern the use of the website axysperformance.com or www.axys.hr (hereinafter: "Website") and the online purchase of products through the Website. By using the Website and/or making a purchase, the user fully accepts these Terms.

Use of the Website

The user agrees to use the Website in accordance with the applicable laws of the Republic of Croatia, these Terms, and good business practices. Use of the Website in any way that may jeopardize, disable, damage, or overload its functioning is prohibited.

Payment Methods and Conditions

Payment can be made by credit or debit cards (Visa, Mastercard, Maestro, Diners, Discover).

All payments are made in euros (EUR).


Shipping & Delivery Costs

Delivery time: Usually 2–5 working days within Croatia, unless otherwise stated at checkout. Actual delivery time may vary depending on the selected courier, location, and external factors beyond our control.

Shipping cost: Depends on package weight, courier choice, and delivery speed. The exact amount will be displayed before checkout is completed.

Free shipping may be available for specific products or promotions, which will be clearly indicated.


Right of Withdrawal (14-Day Return)

In accordance with the Consumer Protection Act, the customer has the right to unilaterally withdraw from a contract concluded remotely or outside of business premises, without giving any reason, within 14 days from the day the goods were received by the customer or a third party designated by the customer (other than the carrier).

To exercise the right of withdrawal, the customer must notify us of their decision in an unambiguous statement (by mail or email) before the expiry of the withdrawal period, including full name, address, phone number, and email address.


Liability for Material Defects

Axys j.d.o.o. is liable for material defects of products in accordance with the Civil Obligations Act and the Consumer Protection Act. Material defects must be documented by the customer via video (showing product usage and visible deformation). If the customer refuses to document the defect, they may return the unused items (at their own cost) to our address for testing. If a defect is confirmed, the customer is entitled to a refund within 14 days.


Returns & Refunds

Due to the hygenic nature of the product, we do not accept returns of opened packages. Returns are accepted only for items that are unopened, unused, and undamaged. In such cases, the customer is entitled to a refund within 14 days of our receipt of the returned goods.


Unclaimed Shipments

The customer is obligated to accept delivery within the timeframe defined by the courier service.

If the package is returned to us due to non-collection, the following applies:

1st Return

After the package is in possesion of the delivery service, the delivery service establishes contact with customer. It is upon customer's duty to notify Axys j.d.o.o. if they failed to pick up their package, and the package is returning to Axys j.d.o.o. facilty.

Customer can:

Request reshipment (must cover the full shipping cost, even if free shipping was used initially — it is considered consumed upon first shipment attempt).

Request a refund (reduced by actual delivery and return costs).

If the customer does not act accordingly within 10 days of notification, we reserve the right to retain the payment until further notice.

2nd Return

The customer is responsible for tracking the shipment (via email, SMS, or phone notifications) and collecting the package within the carrier’s deadline (usually 5 days, depending on the carrier).

After the second return, the customer must contact Axys j.d.o.o. within 10 days and clearly state whether they:

Want a new shipment (with new delivery payment), or

Want a refund (reduced by all delivery and return costs).

If no contact is made within 10 days of return, we reserve the right to:

Deny refund, and/or

Consider the goods abandoned with no further obligation.


Data Protection

Axys j.d.o.o. is committed to protecting customer personal data in accordance with the General Data Protection Regulation (GDPR) and national data protection laws.


Complaints

Customers have the right to submit a complaint regarding products or services. Complaints can be submitted via our contact page. Please include problem details and contact information so we can resolve the issue efficiently.


Dispute Resolution

In the event of a dispute, Axys j.d.o.o. and the customer will aim to resolve it amicably. If this is not possible, the competent court in Zagreb shall have jurisdiction.


Final Provisions

Axys j.d.o.o. reserves the right to amend these Terms without prior notice. Customers are required to review the current Terms before each purchase.

These Terms come into force upon publication on the Website.
